The use of an emergency warning system or wireless emergency warning tones is prohibited by FCC rules “to avoid confusion in the use of the tones, listener fatigue, and false activation of the system by operational data elements contained in the emergency tones,” the agency said.

ESPN added that ESPN has a history of violating FCC rules and was fined in 2015 and 2021 for emergency alert violations.
